A client is importing industrial equipment from Germany to India for the first time. They've asked me to prepare a complete checklist of documents required for customs clearance. I have the standard list but want to make sure I'm not missing anything for capital goods / machinery.

Can someone share a comprehensive list? Also, are there any specific requirements for machinery that don't apply to regular commercial goods?

Here is the complete document checklist for customs clearance of imported goods in India under the Customs Act 1962:

Mandatory Documents (all shipments):

  1. Bill of Entry (BoE) — filed by the CHA in ICES (Indian Customs EDI System). Three types: Into Home Consumption (White), Into Warehousing (Into Bond, Yellow), Ex-Bond (Green)
  2. Commercial Invoice — must include: seller and buyer details, HS code, unit price, total value, currency, country of origin, terms of sale (Incoterms)
  3. Packing List — must match invoice exactly: item descriptions, quantities, net/gross weights, dimensions per package
  4. Bill of Lading (Ocean) or Air Waybill (Air) — original or telex release / express BL acceptable
  5. Import Export Code (IEC) — importer's 10-digit code issued by DGFT
  6. GSTIN — for GST-registered importers

For Machinery / Capital Goods specifically:

  1. Certificate of Origin — required if claiming preferential duty rates under FTAs (India-EU FTA in progress, but India-Japan CEPA, India-ASEAN CETA may apply to German goods via third-country routing — verify)
  2. Technical specifications / Catalogue — customs may require this to correctly classify HS code
  3. Test Report or Conformity Certificate — for equipment subject to BIS (Bureau of Indian Standards) mandatory certification
  4. EPCG License (if applicable) — Export Promotion Capital Goods scheme allows import of capital goods at concessional duty if the importer commits to export obligations
  5. Factory License / Industrial Registration — sometimes requested to verify end-use of capital goods at concessional duty rates

Other frequently required documents:

  1. Insurance Certificate or Policy — for CIF shipments; for FOB, your own policy
  2. Letter of Credit / Payment proof — may be requested for high-value shipments
  3. NOC from relevant authority — for restricted goods (some equipment requires NOC from PESO, MoEF, Drug Controller, etc.)

For German machinery, also check if the goods fall under any dual-use export controls — in that case you may also need the German export license number on the invoice.

Priya's list is comprehensive. Two additions from my experience handling similar Germany-India shipments:

Advance Filing: India requires advance filing of the Import General Manifest (IGM) by the shipping line 24 hours before arrival. As the importer/CHA, ensure your documents reach your forwarder/CHA at least 7–10 days before the vessel arrives so the BoE can be filed in advance. Advance filing gets you an "Out of Charge" (OOC) quickly after arrival and minimises demurrage.

HS Code accuracy is critical in India: Indian customs officers are strict about HS code classification, and the duty rates vary significantly even within sub-headings. For industrial equipment, I recommend getting a pre-import HS code opinion from your CHA or, for high-value shipments, filing for an Advance Ruling with the customs authority. Wrong classification can lead to demand notices for duty differences + penalties even after clearance.

Practical tip on document presentation: since India moved to faceless assessment for most categories, physical document submission is no longer required. Documents are uploaded in the ICES/ICEGATE system.

However, for first-time importers or first-time imports from a new supplier, customs officials can request physical examination and document verification. Keep originals available with your CHA for at least 12 months after clearance, as post-clearance audits by DRI or customs auditors can happen anytime within 5 years.

Also, make sure your German supplier issues the invoice with the correct GSTIN of the Indian importer in the consignee field — this is required for availing IGST credit on the import.
